Costello’s history shows dismissed charges due to incompetency

According to the July 19, 2023 order, granting State’s motion for pre-trial detention of Joseph Castello, he has been convicted of many violent misdemeanors up through 2018. Over the past eight months he has had a long history of accosting and bothering people on the Dragonfly Trail, and on trails in Dona Ana County. Specifically, he accosted the Silver High School Cross Country team, their coach, and another adult. He also accosted a named adult while making ‘nonsensical’ claims regarding issues between him and the government. These victims perceived Costello to be mentally ill and noted at the conclusion of his tirade, Costello would leave the scene and fire his gun. The order states in none of those events prior to Mr. Timmons’ death did Costello harm anyone or point his gun at anyone, but he did frighten them.

Sixth Judicial District Court Judge Jim Foy ruled Wednesday, July 19, in favor of the prosecution in the matter of pretrial detention of Joseph Costello, charged with first degree murder in the June 26, 2023, death of Stephen Timmons. Foy ordered Costello to be held without bond at the Grant County Detention Center during the pendency of this case.
District Attorney Michael Renteria told the Beat, to his way of thinking, there were three main reasons, among others, the State's motion for pre-trial detention was granted.
First, was Costello's behavior in court. He constantly interrupted his attorney and the judge ignoring admonishments not to interrupt. The order also stated his outbursts were designed to hamper the court's ability to complete the hearing as scheduled.

PHOENIX, AZ, July 20, 2023 - Freeport-McMoRan Inc. (NYSE: FCX) reported second-quarter 2023 net income attributable to common stock of $343 million, $0.23 per share, and adjusted net income attributable to common stock of $500 million, $0.35 per share, after excluding net charges totaling $157 million, $0.11 per share, primarily associated with charges for an unfavorable tax ruling at Cerro Verde, adjustments to environmental obligations and an accrual of a potential administrative fine in Indonesia. Dark, Divide, and Davis fires update for July 19, 2023

RESERVE, NM, July 19, 2023 – The Dark, Divide, and Davis fires are burning with low to moderate fire intensity on the Gila National Forest, Reserve Ranger District. All of these fires were started by lightning strikes last week. Incident Commander Pete Valenzuela assumed command of the cluster of fires Monday evening.
The Davis Fire, located north of Collins Park and east of the Continental Divide Trail, has grown to 177 acres (an estimate of 233 acres yesterday was adjusted down due to more accurate infrared mapping). Crews conducted burnout operations today southward along the eastern and western flanks from northern control lines. Ignitions assist with securing identified containment features by removing available fuels, creating a more effective barrier to fire growth. Crews will monitor Continental Divide Trail for users who could be exposed to fire as it moves across the landscape. The affected section of Continental Divide Trail is located east of Eagle Peak from Cox Canyon trailhead south to Bursum Road. Signs are posted north and south of the Davis Fire. Two Hotshot crews, one Type 6 engine, one dozer, one Fire Use Module and various overhead are currently assigned to the Davis Fire.

PRECAUTIONARY/PREPAREDNESS ACTIONS...
Drink plenty of fluids, stay in an air-conditioned room, stay out
of the sun, and check up on relatives and neighbors. Young
children and pets should never be left unattended in vehicles
under any circumstances.
Take extra precautions if you work or spend time outside. When
possible reschedule strenuous activities to early morning or
evening. Know the signs and symptoms of heat exhaustion and heat
stroke. Wear lightweight and loose fitting clothing when
possible. To reduce risk during outdoor work, the Occupational
Safety and Health Administration recommends scheduling frequent
rest breaks in shaded or air conditioned environments. Anyone
overcome by heat should be moved to a cool and shaded location.
