Two other individuals were arrested Tuesday, Mar. 21, at 605 Hutchinson Street, Santa Clara, along with Rudy Marquez III, 36, of Bayard, who is accused of shooting another man in the leg on Mar. 12, during an argument.

Marquez has been charged with aggravated battery with a deadly weapon, a felon in possession of a firearm, and tampering with evidence. He has been released on a $75,000 cash only bond and is to wear an ankle bracelet, according to a Grant County Sheriff's Department news release.

Investigators executed a search warrant at 173 North Hurley Road on the day of arrest and recovered the handgun used in the shooting, GCSD Lt. Fermin Lopez said.

According to the GCSD, also arrested were Ace Alvarez, 35, of Santa Clara on an outstanding warrant with a $331 cash or surety bond out of Judge Laney's Magistrate I Court for failure to appear, and Leonela Pena, 29, of Hurley, on an outstanding warrant with a $753 cash only bond out of Judge Grijalva's Magistrate II Court for failure to pay.

All three were arrested without incident.

Alvarez is no longer at the Grant County Detention Center, while Pena remains incarcerated there.

Marquez was arrested in January 2010, in Texas, Lopez stated, for aggravated assault with a deadly weapon.
