On October 15, 2012, at about 12:40 am, A Silver City Police Officer observed a maroon Ford Explorer drive into the parking lot of Lawley Ford.  The officer called for additional officers to assist and then drove to the area close to the parking lot where he got out of his unit. After the other officers arrived they continued on foot into the parking lot towards the location of the maroon Ford Explorer.

The officers located a suspect, Xavier Benavidez, 42 years of age, squatting down attempting to remove a tire from a Jeep with tools. As a result of the ensuing investigation, Benavidez was placed under arrest. While searching Benavidez the officers found drug paraphernalia, (a pipe with residue) and a white plastic baggie containing a white powdery substance which tested presumptive positive for cocaine.



Benavidez, who is from Silver City, was arrested and charged with Attempted Larceny, a misdemeanor, Possession of Burglary Tools, a 4th degree felony  Possession of a Controlled Substance, a 4th degree felony, Possession of Drug Paraphernalia, a misdemeanor, and Injuring or Tampering with Motor Vehicle, a misdemeanor.

Benavidez was transported to the Grant County Detention Center and booked in. His bond was set at $12,000.
