Failure to Adhere to State Law in Taos and Guadalupe Counties Opens Door to Ballot Harvesting and Fraud


ALBUQUERQUE, OCTOBER 27 — The Republican Party of New Mexico has filed a lawsuit in the First Judicial District Court against the Secretary of State's Office and two County Clerks over absentee ballot drop box violations. RPNM charges that county officials in Taos and Guadalupe Counties have failed to provide mandated security measures at their drop box locations.

By law, County Clerks are required to secure and maintain these drop boxes. The boxes must remain under the direct supervision of at least two county staff or election workers at all times. Drop boxes should also be monitored by a video security surveillance system.

These election infractions are in direct violation of the Secretary of State's Drop Box Standards & Guidance procedures. RPNM is asking the state for an injunction to make sure these counties and all others comply with state law regarding the drop box security measures.

RPNM had contacted the Secretary of State's Office about the issues in Taos County. At one point, the Secretary provided written assurance to RPNM that the problem had been resolved with the County Clerk, but the violations continued.

"These are other examples of where election integrity can be in peril," said Republican Party of New Mexico Chairman Steve Pearce. "The Republican Party wants fair and honest elections for everyone. This isn't about Democrats or Republicans. It's about making sure that the law is followed and that there's ballot integrity, and it's imperative that we all have safe and secure elections."

RPNM, GOP leaders, and four County Clerks also filed a lawsuit over the weekend in the New Mexico Supreme Court over inconsistencies in absentee ballot processing.
