Farmington, NM -- Today, Attorney General Hector Balderas and Eleventh Judicial District Attorney Rick Tedrow announced that Lindsey Moss and Dallas Baron were both convicted of multiple counts of child abuse, contributing to the delinquency of a minor, and battery, following two separate jury trials.  Prosecutors presented evidence that Moss and Baron partnered together to record themselves abusing an eight-year-old boy with Down Syndrome. While babysitting the young boy, Moss and Baron were seen making videos of themselves throwing things at the child, teaching him to smoke from a bong, and pushing him down.  The females can be heard laughing about their actions in the videos. 

“No child, especially children with special needs, should have to be put through such abusive bullying by the people entrusted to protect them,” said Attorney General Balderas. “My office will continue to pursue justice for the most vulnerable New Mexicans who are unable to protect themselves.”

“I am pleased with the verdicts in these two cases,” said DA Tedrow.  “I am grateful to the family for their bravery and to the jurors for their service.”

Judge Daylene A. Marsh ordered both Defendants to undergo 60-day diagnostic evaluations at the Department of Corrections prior to sentencing. Baron faces up to 11 and a half years in prison and Moss faces up to eight years in prison at sentencing; no sentencing date is currently set.  These cases were prosecuted by Deputy District Attorney Christopher Spinner in collaboration with Special Assistant Attorneys General Mark Probasco and Zach Jones.
