PROCLAMATION
NOTICE OF SPECIAL ELECTION TO BE HELD ON AUGUST 22, 2023

NOTICE IS HEREBY GIVEN that on August 22, 2023 there will be held in Grant County a special local gross receipts tax election for the purpose of submitting to the registered qualified electors of the County the question of whether Ordinance No. 12-03 should be amended and the sunset clause be repealed.

At the election, the following question shall be submitted to the registered qualified electors of the County:

Shall Section 6 of Ordinance No. 12-03 be amended to remove Section 6 in order to prevent its repeal on December 31, 2023 and allow for the continued collection of the gross receipts tax for countywide emergency communications and emergency medical and behavioral health services?

If the answer to the question is yes, Ordinance No. 12-03 shall be amended, removing Section 6, as follows:

Section 1. Imposition of Tax. There is imposed on any person engaging in business in the county for the privilege of engaging in business in the county an excise tax equal to one-eighth of one percent (.125%) of the gross receipts reported or required to be reported by the person pursuant to the New Mexico Gross Receipts and Compensating Tax Act as it now exists or as it may be amended. The tax imposed under this ordinance is pursuant to the County Local Option Gross Receipts Taxes Act as it now exists or as it may be amended and shall be known as the "countywide emergency communications and emergency medical and behavioral health services tax."

Section 2. General Provisions. This ordinance hereby adopts by reference all definitions, exemptions and deductions contained in the Gross Receipts and Compensating Tax Act as it now exists or as it may be amended.

Section 3. Specific Exemptions. No countywide emergency communications and emergency medical and behavioral health services tax shall be imposed on the gross receipts arising from:

A. Transporting persons or property for hire by railroad, motor vehicle, air transportation or any other means from one point within the county to another point outside the county; or

8.  Direct broadcast satellite services.

Section 4. Dedication. Revenue from the countywide emergency communications and emergency medical and behavioral health services tax shall be dedicated to one or more of the following purposes:

  1. Operation of an emergency communications center that has been determined by the Local Government Division of the Department of Finance and Administration to be a consolidated public safety answering point; or
  2. Operation of emergency medical services provided by the county; or
  3. Behavioral health services.

Section 5. Effective Date. The effective date of the countywide emergency communications and emergency medical services tax shall be January 1, 2013.

Section 6. Delayed Repeal. Ordinance No. 0-12-03 (if it becomes law) is repealed effective December 31, 2023.
The tax contemplated by this question shall be pursuant to the “Countywide emergency communications and emergency medical and behavioral health services tax act,” NMSA 1978, Section 7-20E-22.
A person is a qualified elector of the county if, on the day of the election, he or she is a citizen of the United States, at least 18 years of age, and a resident of the county. In order to vote, qualified electors of the District must have previously registered with the Grant County Clerk, or any voter registration agent. Any qualified elector of the District who is not now registered and wishes to vote at the election should register no later than 5:00 p.m. on July 25, 2023, getting the 28th day preceding the election, during regular business hours and days of business, at the office of the Grant County Clerk, the Grant County Courthouse, or by voter registration agents at a designated agency pursuant to NMSA 1978, Section 1-4-48 and 49. Registration books close at the end of the day on July 25, 2023 pursuant to NMSA 1978, Section 1-4-8.
Pursuant to NMSA 1978, Section 1-24-3(C), voting at this special election shall be conducted by mail ballot.
Pursuant to NMSA 1978, Section 1-24-3, the Grant County Clerk shall send each registered voter a ballot with a pre-paid, postage stamped return envelope. There shall be no polling places for this special election.
IN TESTIMONY WHEREOF, the Board of Grant County Commissioners, being the governing body of the County, has caused this notice to be published as required by law and dated this 13th day of June 2023.

CONDADO DE GRANT, NUEVO MÉXICO
PROCLAMACIÓN
AVISO DE ELECCIÓN ESPECIAL QUE SE CELEBRARÁ EL 22 DE AGOSTO DE 2023

POR LA PRESENTE SE NOTIFICA que el 22 de agosto de 2023 se llevará a cabo en el Condado de Grant una elección especial local de impuestos sobre los ingresos brutos con el fin de presentar a los electores calificados registrados del Condado la cuestión de si la Ordenanza No. 12-03 debe enmendarse y derogarse la cláusula de extinción.

En la elección, la siguiente pregunta se presentará a los electores calificados registrados del Condado:

¿Se debe enmendar la Sección 6 de la Ordenanza No. 12-03 para eliminar la Sección 6 a fin de evitar su derogación el 31 de diciembre de 2023 y permitir la recaudación continua del impuesto sobre los ingresos brutos para las comunicaciones de emergencia en todo el condado y los servicios médicos y de salud  mental de emergencia?

Si la respuesta a la pregunta es afirmativa, se modificará la Ordenanza Nº 12-03, suprimiendo el artículo 6, de la siguiente manera:

Sección 1. Imposición de impuestos.  Se impone a cualquier persona que participe en negocios en el condado por el privilegio de participar en negocios en el condado un impuesto especial equivalente a un octavo del uno por ciento (.125%) de los ingresos brutos reportados o requeridos para ser reportados por la persona conforme con la Ley de Ingresos Brutos e Impuestos Compensatorios de Nuevo México tal como existe ahora o como puede ser enmendada. El impuesto obligado bajo esta ordenanza es de conformidad con la Ley de Impuestos sobre los Ingresos Brutos de la Opción Local del Condado tal como existe ahora o como puede ser enmendada y se conocerá como el "impuesto de comunicaciones de emergencia y servicios de salud médica y mental de emergencia en todo el condado".

Sección 2. Disposiciones generales. Esta ordenanza adopta por referencia todas las definiciones, exenciones y deducciones contenidas en la Ley de Ingresos Brutos e Impuestos Compensatorios tal como existe ahora o como puede ser enmendada.

Sección 3. Exenciones específicas. No se impondrá ningún impuesto de comunicaciones de emergencia y servicios médicos y de salud mental de emergencia en todo el condado sobre los ingresos brutos derivados de:

A. Transporte de personas o propiedades para alquiler por ferrocarril, vehículo motorizado, transporte aéreo o cualquier otro medio de un punto dentro del condado a otro punto fuera del condado; o

B. Servicios de transmisión directa por satélite.

Sección 4. Dedicación. Los ingresos del impuesto de comunicaciones de emergencia y servicios de salud médica y mental de emergencia en todo el condado se dedicarán a uno o más de los siguientes propósitos:

  1. Operación de un centro de comunicaciones de emergencia que ha sido determinado por la División de Gobierno Local del Departamento de Finanzas y Administración como un punto de respuesta de seguridad pública consolidado; o
  2. Operación de servicios médicos de emergencia proporcionados por el condado; o
  3. Servicios de salud Mental.

Sección 5. Fecha de entrada en vigor. La fecha de vigencia del impuesto de comunicaciones de emergencia y servicios médicos de emergencia en todo el condado será el 1 de enero de 2013.

Sección 6. Derogación diferida. La Ordenanza No. 0-12-03 (si se convierte en ley) queda derogada a partir del 31 de diciembre de 2023.
El impuesto contemplado en esta pregunta será de conformidad con la "Ley de impuestos de comunicaciones de emergencia y servicios de salud mental y comunicaciones de emergencia en todo el condado", NMSA 1978, Sección 7-20E-22.
Una persona es un elector calificado del condado si, el día de la elección, él o ella es ciudadano de los Estados Unidos, tiene al menos 18 años de edad, y residente del condado. Para votar, los electores calificados del Distrito deben haberse registrado previamente con el Secretario del Condado de Grant, o cualquier agente de registro de votantes. Cualquier elector calificado del Distrito que no esté registrado y desee votar en la elección debe registrarse a más tardar a las 5:00 p.m. del 25 de julio de 2023, obteniendo el día 28 precedente a la elección, durante el horario de negocio regular y los días hábiles, en la oficina del Secretario del Condado de Grant, el Juzgado del Condado de Grant,  o por agentes de registro de votantes en una agencia designada conforme con NMSA 1978, Sección 1-4-48 y 49. Los libros de registro cierran al final del día 25 de julio de 2023 conforme con NMSA 1978, Sección 1-4-8.
Conforme con NMSA 1978, Sección 1-24-3 (C), la votación en esta elección especial se llevará a cabo por correo.
Conforme con NMSA 1978, Sección 1-24-3, el secretario del Condado de Grant enviará a cada votante registrado una boleta con un sobre de devolución prepagado y sellado con franqueo. No habrá lugares de votación para esta elección especial.
EN TESTIMONIO DE LO CUAL, la Junta de Comisionados del Condado de Grant, siendo el cuerpo gubernamental del Condado, ha hecho que este aviso se publique como lo exige la ley y con fecha de este día 13 de junio de 2023.
